ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, July 25, 2011 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of James Canavan, 4351 Ridge Road, Glenville NY 12302 for an Area Variance to allow for the placement of a 24’ above ground swimming pool to be located in the front yard of Ridge Road, 50 feet from the front lot line. Said property is located in the Rural Residential/Agricultural Zoning District and is identified on tax map 7.-2-24.
In accordance with the Codes of the Town of Glenville 270-54, A (2): Swimming pools will not be permitted in front yards. Therefore the applicant is seeking total relief from the ordinance.
Application of Capital Architecture, on behalf of Anthony Ruggerio, property owner, for an Area Variance to allow for the construction of a 15’ x 35’ addition to the front of the Flight Line Pub, 20 Saratoga Road, Glenville, NY 12302. The proposed addition would have a front setback of 29 ± feet. Said property is located in a General Business Zoning District and is identified on tax map 30.6-3-9.
In accordance with the Codes of the Town of Glenville 270 Attachment 1 the minimum front setback is 35’. Therefore the applicant is seeking a front setback variance of 6 feet.
Application of Patricia Brennan, 664 Kinns Road, Clifton Park, NY 12302 for 1 Area Variance on Proposed Lot 1A of property owned by Jerry Riggi, 713 Glen Ave., Glenville, NY 12302. The applicant is seeking to subdivide the existing Lot 1 of the Riggi Subdivision into 2 lots and the subsequent construction of one single family dwelling (townhouse unit) with a 0 foot side yard setback. The property is located at the intersection of Mohawk Ave (NYS Rt. 5) and Cramer Ave. Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.7-1-36.
In accordance with the Codes of the Town of Glenville 270 Attachment 1 the minimum side yard setback is 15 feet. Therefore, the applicant is seeking a 15 foot side yard variance for Proposed Lot 1A.
Application of Patricia Brennan, 664 Kinns Road, Clifton Park, NY 12302 for 3 Area Variances of Proposed Lot 1B owned by Jerry Riggi, 713 Glen Ave., Glenville, NY 12302. The applicant is seeking to subdivide the existing Lot 1 of the Riggi Subdivision into 2 new lots and the subsequent construction of one single family dwelling (townhouse unit). Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.7-1-36.
In accordance with the Codes of the Town of Glenville 270-Attachment 1, the following 3 variances are requested for Proposed Lot 1B:
Variance #1: Minimum Lot Size
Required: 15,000 s/f
Proposed: 8,200 s/f. Therefore a 6,800 s/f variance is requested.
Variance #2: Minimum Lot Width
Required: 100 feet
Proposed: 55 feet. Therefore a 45 foot variance is requested.

The applicant is seeking to subdivide the existing Lot 4 of the Riggi Subdivision into 2 new lots and the subsequent construction of one single family dwelling (townhouse unit). Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.7-1-36.
In accordance with the Codes of the Town of Glenville 270-Attachment 1, the following 2 variances are requested for Proposed Lot 4B:
Variance #1: Minimum Lot Size
Required: 22,500 s/f (must be 50% larger for corner lot)
Proposed: 18,500 s/f. Therefore a 4,000 s/f variance is requested.
Variance #2: Minimum Side Yard Setback
Required: 15 feet
Proposed: 0 feet. Therefore a 15’ variance is requested.
Application of Mohawk Honda, 175 Freemans Bridge Road, Glenville, NY 12302 for 4 Sign Variances that will allow for the placement of a 6 foot high ground sign at the southern most entrance on Ballston Road (Rt. 50). Said property is located in a General Business Zoning District and is identified on tax map:
In accordance with the Codes of the Town of Glenville the following variances are requested:
Variance #1: 270-68 (D): No new off premise advertising signs, including billboards will be permitted. Collision/Body shop is not located at this site; therefore, the applicant is seeking total relief from the ordinance.
Variance #2: 270-69 (B) (5): The total amount of s/f for all signs on any one lot is 150 s/f. A prior variance was granted to allow for 289 s/f of total signage on the site. An additional 20 s/f of sign area is proposed. Therefore the applicant is seeking an additional 20 s/f variance.
Variance #3: 270-134 (C) (6) (b) (3) (a): Monument signs and façade signs shall be made of wood, simulated wood, stone, brick, or composite materials. Plastic, aluminum and other metal type materials are only permitted on the sign frame and/or the light housing. Therefore, the applicant is seeking total relief from the ordinance.
Variance #4: 270-134 (C) (6) (b) (6): Sign lighting should minimize glare and maintain the aesthetic character of the area. Therefore, signs may not be internally lit, but raised lettering signs may be backlit. All other signs shall be externally lit. Therefore, the applicant is seeking total relief from the ordinance.
